Cross-border services within the meaning of Directive 2006/123/EC

EU/EEA citizens may be exempt from

• the business advertisement or
• the obligation to obtain a permit for travel traders, or
• the obligation to notify in the travel industry or
• the announcement of a travelling camp, or
• the prohibition on the pursuit of the auctioneer trade as a travel trade,

if they are entitled to carry out one of the above-mentioned activities in the country of origin and wish to work in Germany only temporarily independently on a commercial basis from their establishment in the country of origin.

The documents from the home Member State required for the commercial activity must be carried in Germany and presented during official inspections.

Responsible bodies in Rhineland-Palatinate are: municipal administration of the non-affiliated municipality, the Verbandsgemeindeverwaltung and, in district-free and large district-affiliated cities, the city administration.

Depending on the type of activity to be carried out in Germany, the obtaining of additional permits or permits under special laws may be necessary, which must be observed (e.B. a special use permit).

• The self-employed commercial activity may only be of a temporary nature.

If you are planning to become commercially active in Germany on a permanent basis, the national regulations of the Industrial Code, in particular notification and licensing obligations, apply without restriction.

• The activity must be carried out by a separate establishment in the country of origin.

An establishment within the meaning of the Industrial Code exists if an independent commercial activity is actually carried out for an indefinite period and by means of a fixed establishment from it.

It is necessary to carry all documents entitling the holder to carry out the commercial activity from the establishment in the country of origin.
