Granting a residence permit Mobile ICT card
Source: BUS Rheinland-PfalzYou can obtain a Mobile ICT Card if you are to work as a manager, specialist or trainee in a German branch of a foreign company.
The Federal Employment Agency must approve your employment. In particular, the Federal Employment Agency will check your activity as a manager, specialist or trainee as well as your salary and working conditions.
The residence permit is issued for the duration of the internal transfer within the company, but for at least 90 days. However, the stay in Germany may not exceed three years for managers/specialists and one year for trainees. At the same time, the planned stay in Germany may not be longer than the stay in the EU member state that issued the residence permit for the purpose of the intra-company transfer.
The procedure is as follows:
- Depending on the foreigners authority and your request, it may be possible to apply via the Internet. Find out whether your foreigners authority offers electronic applications.
- If the application can only be made in person, make an appointment with the immigration office. During the appointment, your application will be accepted and your supporting documents checked (bring these with you to the appointment). Your fingerprints will be taken to produce the MobilerICT card.
- In the case of an electronic application, the Foreigners' Registration Office will contact you after receiving your online application to arrange an appointment at the Foreigners' Registration Office if necessary. During the appointment, your documents will be checked (bring them with you to the appointment) and your fingerprints will be taken for the production of the mobile ICT card.
- If your application is approved, the Foreigners' Registration Office will arrange for the Mobile ICT Card to be issued.
- After about six to eight weeks you can collect the MobilerICT card from the immigration office.
- Thee Mobile ICT Card must always be collected in person.
Alternatively, you can send the application to the Federal Office for Migration and Refugees via the BSCW server (https://bscw.bund.de). The responsible immigration authority will then decide on the application.

Alternatively, you can also send the application to the Federal Office for Migration and Refugees (https://bscw.bund.de). The responsible immigration authority will then decide on the application.
- You have a recognized and valid passport or passport substitute.
- You have a residence permit from another member state valid for the duration of the application procedure for the purpose of internal transfer within the company.
- You are to be employed as a manager, specialist or trainee in Germany.
- The intra-company transfer in Germany should last more than 90 days.
- You can present an employment contract valid for the duration of the transfer and, if necessary, a letter of secondment.
- The Federal Employment Agency has approved the employment.
- There are no grounds for deportation against you.
- Your stay does not jeopardize or impair the interests of the Federal Republic of DeGermany.
- You can secure your livelihood and health insurance cover from your own resources without claiming public benefits.
- Valid passport or passport substitute
- Residence permit from another EU Member State for internal transfer within the company
- Current biometric photo
- Proof of your qualifications (e.g. university certificate, certificate of completed vocational training)
- Proof of professional experience (e.g. job references)
- Employment contract or letter of secondment, if required
- Proof of means of subsistence (e.g. equity capital, proof of income, blocked account, declaration of commitment)
- Proof of your health insurance
- Current registration certificate
In individual cases, the Immigration Office may request the submission of further documents.

Notes:
- For the issuanceFor the issuance of the residence permit in the form of an electronic residence permit, which can also be used as electronic proof of identity, additional fees may apply.
- The time andand the form of fee collection and payment vary depending on the authority.
- If you are already in Germany for short-term mobility, you must submit the application at least 20 days before the end of your stay for short-term mobility.
- If you are still abroad, you must submit the application at least 20 days before entering Germany.
- If you have submitted the application 20 days before your entry, you may stay in Germany for up to 90 days within a 180-day period until the immigration authority has made a decision.days within 180 days in Germany and work.

An appeal against a decision by the immigration authority can be lodged with the authority named in the decision within one month of notification of the decision. The appeal may be lodged in writing, in electronic form or for the record.
If the foreigners authority does not uphold the appeal, an action may be brought before the court named in the notice of appeal.
