Co-naturalisation of a minor child Application
Source: BUS Rheinland-PfalzYour minor child can be naturalised together with you as the parent if you meet the requirements for independent naturalisation and apply for naturalisation. The naturalisation authority decides on the co-naturalisation of your child at its discretion. The naturalisation becomes effective upon delivery of the certificate of naturalisation.
If your child is younger than 16 years old, you can enter his or her data in your application form. However, a separate application for the child can also be submitted later. It is sufficient if the application for co-naturalisation is submitted in good time before your naturalisation. The consent of the other parent is required; unless you have sole custody. If your child is already 16 or 17 years old, he or she must apply for co-naturalisation himself.
The competent authorities for naturalisations are the district administrations and city administrations of the district-free cities. These authorities advise on naturalisation free of charge and without obligation. The possibility of advice exists independently of an application.
In rural districts, the naturalisation application can also be submitted to the municipal administrations of the municipalities without associations, the Verbandsgemeindeverwaltungen and the city administrations of the large cities belonging to the district.
- The parent to be naturalised has custody of the child and lives with him or her in a family partnership.
- The child has been living legally and permanently in Germany for at least three years. If the child is younger than six years of age at the time of naturalisation, it is sufficient if he or she has spent half his or her life in Germany immediately before naturalisation.
- The child has German language skills that are developed according to age.
- There are no grounds for exclusion for naturalisation. A commitment to the free democratic basic order and a declaration of loyalty are not required of minor children who have not yet reached the age of 16 at the time of naturalization or co-naturalization.
Requirements for children who have reached the age of 16
If your child has reached the age of 16, he or she must meet all the requirements for independent naturalisation. These include, for example: sufficient knowledge of the German language, commitment to the free democratic basic order, no conviction for a crime.
Children to be naturalized are always required:
- valid identity document (passport, travel document or passport substitute of the child or his or her parent in which the child is registered)
- Birth certificate of the child or extract from the register of the birth record
Which additional documents are required depends on the individual case. Early advice from the naturalisation authority is advisable. This can list you exactly which documents are necessary for the co-naturalization of your child.
- EUR 51 for a minor child who is naturalised and has no income of his or her own within the meaning of the Income Tax Act.
If the application is withdrawn or rejected, the fee is reduced.
Additional costs may be incurred in individual cases due to the procurement of civil status certificates proof of identity or the renunciation of the previous nationality.
The application for co-naturalisation should, if possible, be submitted at the same time as the application for naturalisation of the parents or one of the parents. However, the co-naturalisation must be applied for in good time before the naturalisation of the parents or one of the parents.
