Source: BUS Rheinland-PfalzIn order to protect against dangers posed by drivers and owners who repeatedly violate traffic regulations, the driving licence authority must take appropriate measures in accordance with the driving aptitude assessment system.
Contact the driving licence authority of your district or district-free city or large city belonging to a district (main residence).
Once a certain number of points has been reached, the Federal Motor Transport Authority informs the driving licence office responsible for the road user. The Commission initiates appropriate measures.
Principles:
Reservation (up to 3 points):
No action will be taken against the person concerned; the term "reservation" clarifies this more clearly than before. Those affected have the opportunity to voluntarily attend a driving aptitude seminar. You will receive a point deduction of 1 point for this.
1st level of action (4 or 5 points): "Admonition"
As a person who is repeatedly conspicuous, the holder of the driving licence will receive a warning and information about the driving aptitude assessment system. In addition, it is pointed out that a driving aptitude seminar can be attended voluntarily as an aid to improving individual driving ability. A deduction of 1 point will be granted for this. A point deduction is generally only granted once every 5 years.
Level 2 (6 or 7 points): "Warning"
The driver's license holder, who continues to be conspicuous, receives a harsher warning with reference to the threat of withdrawal of the driver's license in the event of further violations. Here, too, it is pointed out that a driving aptitude seminar can be attended voluntarily. At this level, however, there is no point deduction.
3rd level of action (from 8 points): Withdrawal of the driving licence
Anyone who has shown himself to be unfit for road traffic as a result of such repeated violations will be deprived of their permission to continue to participate in road traffic by motor for at least six months in order to protect the general public.
All stages of action must be completed before the driving licence can be revoked. The respective action will only be taken when one of the points mentioned above is reached for the first time. However, depending on the cancellation of registered decisions, the stages can be passed through several times when the corresponding points balance accumulates again.
The points are entered for administrative offences of 60 € or more as well as for driving bans and traffic offences of any kind
Each violation is statute-barred. The following repayment periods apply:
- Administrative offenses with 1 point = 2.5 years
- Administrative offences with 2 points = 5 years
- Offences with 2 points = 5 years
- Offences with 3 points = 10 years
Driving Aptitude Seminar
The driving aptitude seminar consists of two sub-measures, which are coordinated with each other:
- a traffic education sub-measure and
- a partial traffic psychology measure.
Traffic education sub-measure
The traffic education sub-measure is carried out by specially trained driving instructors. The content is individually tailored to the violations committed by the participants. In addition, efforts are being made to improve risk awareness and behavioural alternatives. The measure consists of two modules of 90 minutes each and can be carried out as an individual measure or in groups of up to six participants.
Traffic psychology sub-measure
As part of the traffic psychology sub-measure, individual ways to change risky driving behaviour are shown with the help of specially trained traffic psychologists. These personal strategies should then be tested in everyday life and the associated experiences discussed with the traffic psychologist. The measure consists of two sessions of 75 minutes each and is carried out as an individual measure.
The driving licence authority charges fees in accordance with the Schedule of Fees for Road Traffic Measures (GebOSt).
If the driving licence holder has taken part in a driving aptitude seminar in order to achieve 5 points and submits a certificate to the driving licence authority within two weeks of the end of the seminar, 1 point will be deducted.
A point deduction is generally only granted once every 5 years.
