Apply for recognition of a guardianship association
Source: BUS Rheinland-PfalzIf you want to run a care association whose employees provide care and legal representation for people on the basis of a court order, this association must be recognized by the state.
An association with legal capacity can be recognized as a care association if it guarantees that it
- has a sufficient number of suitable employees and will supervise, train and adequately insure them against any damage they may cause to others in the course of their work,
- makes planned efforts to recruit volunteer guardians, introduces them to their tasks, provides them with further training and advises and supports them and authorized representatives in the performance of their tasks,
- provides scheduled information on powers of attorney and care orders and
- facilitate an exchange of experience between employees.
In addition, the association must be managed by persons who are suitable for this purpose in terms of their personality, training or professional experience and who are not in a relationship of dependency or any other close relationship with an institution in which people cared for by the association or members of the association are accommodated.
Recognition is valid for the respective country; it can be limited to individual parts of the country. It is revocable and can be granted subject to conditions.
