In the case of the mayor's will, the will is drawn up by the competent mayor of the testator's place of residence in the presence of two witnesses. The testator must approve these minutes and they must be signed by all parties involved. The testator's signature may be replaced by the statement that he can no longer write his name.
If a testator can no longer leave a place, for example due to a natural disaster or accident and his death, then the establishment of an emergency will is possible by declaring the last will to three witnesses. Here, too, the transcript and signature of all parties involved is necessary. The signature of the testator can also be replaced here.
The Maritime Testament does not presuppose an emergency. However, the testator must be on a sea voyage with a German ship outside a domestic port. Here the last will is explained orally to three witnesses.
