Applying for a permit for a prostitution business
Source: Serviceportal Rheinland-PfalzIf you want to run a prostitution business, you need a permit from the competent authority. The authority has extensive monitoring rights. It can impose legal sanctions for non-compliance with the licensing requirement.
A prostitution business is a business in which sexual services are offered commercially by at least one other person and/or premises are provided for this purpose.
You require a permit if you
- operate a prostitution establishment, i.e. use a building, individual rooms or other fixed facilities to offer sexual services, for example as a brothel, walk-in brothel or tantra massage studio,
- provide a prostitution vehicle for the provision of sexual services, for example a bus, camper van, caravan or boat,
- organize or conduct a prostitution event for an open circle of participants at which sexual services are offered for payment by at least one of the persons directly present, or
- operate a prostitution agency, i.e. arrange for at least one other person to provide sexual services outside of the operator's prostitution establishments, for example a call boy or call girl agency or an escort agency. This also applies if it is only apparent from the circumstances that the procured services also include sexual acts.
The competent authority may limit the permit and impose conditions.
The permit for the provision of a prostitution vehicle is valid for a maximum of 3 years. You can extend it on application.
If you wish to operate your prostitution business through a proxy, you will also require a proxy permit.
Please note that in addition to the permit requirement for the prostitution business, other permit or notification requirements apply in accordance with other regulations:
- Catering trade,
- trade protection
- building protection
- water protection
- immission control
- Special use of public road areas
If you want to run a prostitution business, you need a permit from the competent authority. A prostitution business is a business in which commercial services in connection with the provision of sexual services by at least one other person are offered or premises are provided for this purpose.
A permit is required by any person who
- offers a prostitution establishment such as a building, individual rooms or other fixed facilities for the provision of sexual services for use (e.g. as a brothel, walk-in brothel, atelier),
- provides a prostitution vehicle for the provision of sexual services (e.g. bus, camper van, caravan, boat),
- organizes or conducts a prostitution event for an open circle of participants at which sexual services are offered for payment by at least one of the persons directly present (e.g. public porn shoot) or
- operates a prostitution agency, i.e. arranges for at least one other person to provide sexual services outside of the operator's prostitution establishments (e.g. call boy/call girl agency, escort agency). This also applies if it is only apparent from the circumstances that the brokered services also include sexual acts.
The permit may be issued for a limited period of time and be subject to ancillary provisions (conditions). The permit for the provision of a prostitution vehicle must be limited to a maximum of three years and can be extended upon application.
Anyone wishing to operate their prostitution business through a deputy also requires a deputy permit.
Please note that, in addition to the permit requirement for the prostitution business, there are other permit or notification requirements under other regulations, in particular under the provisions of restaurant, trade, building, water or immission control law.
