Source: BUS Rheinland-PfalzTemporary structures require a building permit before they are erected and put into use for the first time. This does not apply to the non-procedural temporary structures listed in Section 76 (2) sentence 2 LBauO.
The execution permit replaces the building permit for temporary structures and thus enables the repeated erection, operation and dismantling of these structures at different locations after they have been approved for use.
The body responsible for issuing the construction permit shall check in particular whether the documents submitted are sufficient and suitable as proof of operational and structural safety and whether the required technical evidence and any necessary risk analyses have been properly checked by inspection bodies or experts.
The temporary structure must be erected on a trial basis before the building permit is issued. Trial erection may be dispensed with if it is not required to assess the stability or operational safety of the temporary structure.
As a rule, tents with more than 1,500 visitor seats or with a floor area of more than 750 m², grandstands with more than 500 visitor seats, stages and fairground rides, shows and amusement rides must be erected on a trial basis prior to commissioning.
For all installations of a predominantly mechanical nature, a trial run must be carried out with the most unfavorable loads on which the calculation is based.
The operating permit shall be entered in a test book. It may contain ancillary provisions. These may include special tests or specifications for the construction (e.g. with regard to different installation locations - nature and terrain, type and height of the sub-pallings). A copy of the original construction documents required for the renewal inspection and the acceptance of use, with the inspection note, must be attached to the inspection logbook. The inspection logbook must be document-proof (e.g. bound, no stapling) and have consecutive page numbers.
The approval body in Rhineland-Palatinate is TÜV Rheinland Industrie Service GmbH, Koblenz. Depending on the assigned area, the branch in Kaiserslautern, Koblenz, Mainz and Trier is responsible.
Regulations on the type, number and scope of construction documents for the granting of construction permits are contained in Section 11 of the State Ordinance on Construction Documents and the Technical Inspection of Buildings (BauuntPrüfVO)
The application for a building permit for temporary structures only needs to be accompanied by the construction drawings, the building description and the structural engineering certificates. The construction description must contain sufficient information on the construction, structure and operation of the temporary structures.
The construction documents must be submitted in duplicate to the authority responsible for issuing the construction permit. They must be submitted in German and must consist of paper on fabric; electronic form is excluded.
Fees are charged for the building permit. They are based on the Annex to Section 2 (2) of the State Ordinance on Responsibility and Fees for the Issuance of Construction Permits for Temporary Structures.
According to Section 76 (5) LBauO, building permits must be issued or extended for a specific period of time, which should not exceed five years.
Annex 2 of the circular from the Ministry of Finance dated December 1, 2015 (Building Supervisory Requirements for Temporary Structures) contains the appropriate deadlines for building permits and their extensions, taking into account the special features of temporary structures.
As a rule, disputes in connection with implementation permits are subject to administrative law (objection and subsequent legal action).
Temporary structures require a building permit before they are erected and put into use for the first time.

Before a temporary structure is to be put into operation, the responsible lower building supervisory authority at the installation site must be notified and the inspection logbook must be submitted.
