Apply for a transfer of the rental car permit
Source: BUS Rheinland-PfalzYou must submit an application for the transfer of the permit for the commercial transport of persons with rental cars. You can submit this to the transport authority responsible for you in the respective independent city or district.
To obtain a transfer of the permit for the commercial transport of persons with rental cars, proceed as follows:
- Submit a corresponding application to the transport authority responsible for you in the respective independent city or district and attach all necessary documents to the application.
- The authority will process your application and carry out the necessary consultation procedures.
- You will receive a notification of the transfer of the rental car permit, including the handing over of the approval certificates.
The traffic authority of the respective independent city or district is responsible.
- There is a concluded contract between the transferring and the accepting contracting party, from which the intention to transfer emerges.
- The safety and performance of the operation are guaranteed.
- There are no facts of the unreliability of the applicant as an entrepreneur or of the person appointed to manage the business.
- The applicant as an entrepreneur or the person appointed to manage the business is professionally qualified.
- The applicant and the entrepreneurs commissioned by him or her to carry out transport services have their place of business or branch in Germany within the meaning of commercial law.
- In the case of legal entities under public law, the requirements are deemed to be met.
- informal justification as to why the rental car permit should be taken over
- contract concluded between the transferring and the accepting contracting party, from which the intention to transfer must emerge
- Formal application (surname, first name of the applicant; place of residence and place of business; in the case of natural persons, date of birth, place of birth; Number of vehicles, type of vehicle, capacity of vehicles used)
- References or examination certificates (on professional competence) of the applicant or the person appointed to conduct the business
- Equity certificate / additional certificate (form according to § 2 para. 2 no. 2/ § 2 para.3 of the Ordinance on Access to the Profession for Road Passenger Transport -PBZugV), not older than 3 months
- Certificate of clearance from the tax office, the municipality, the social security institutions and the employers' liability insurance association, not older than 3 months (by the company, the legal representative and the person appointed to manage the business / traffic management)
- Certificate of good conduct for submission to the authority in accordance with § 30 paragraph 5 BZRG
- Excerpt from the Central Trade Register according to § 150 paragraph 5 GewO (for companies)
- Excerpt from the driving aptitude register (FAER)
General documents:
- Vehicle list, if applicable rental vehicles with rental contract or leasing list
- Proof of liability insurance for rental cars including risk index (WKZ)
- Business registration
The amount of the fees depends on:
- the number of vehicles, and
- the duration of the authorisation.
Deadlines do not begin to run until a decision-making application has been submitted. If your application is complete, a decision will be made within 3 months. The period may be extended by 3 months if necessary.
The processing time may vary between the relevant traffic authorities. The processing time may depend, among other things, on whether all documents relevant to the decision have been submitted or whether additional requests for documents become necessary.
