Ensuring operational safety - apply for permission to construct and operate a plant requiring monitoring
Source: BUS Rheinland-PfalzYou will need permission from the competent authority if you:
- want to build and operate a plant requiring monitoring, or
- want to make changes to the design or operation that affect the safety of the installation.
Permission can be granted to you subject to the following restrictions:
- limited
- temporary
- under conditions, or
- with conditions.
If the installation requiring a permit is part of an installation requiring a permit, no separate permit will be issued. The permit includes the permission.
- Submit the application for permission for the installation requiring monitoring to the competent authority with the necessary documents, including the test report of the approved inspection body (ZÜS).
- If there is a permit requirement under the Federal Immission Control Act, you will receive the application documents back, as a permit under the Industrial Safety Ordinance will then be checked as part of the necessary permit under the Federal Immission Control Act.
- The competent authority shall take its decision after examination and shall inform you thereof.
The competent authorities in Rhineland-Palatinate are the Labour Supervision Departments of the Structural and Licensing Authorities North and South.
Regional Offices Trade Inspectorate of the Structure and Approval Directorate North (SGD North) or South (SGD South)
- The plant for which you are applying for the permit must be an installation requiring a permit.
- They must construct and operate the system requiring monitoring in accordance with the state of the art.
- Your documentation must be complete, plausible and meaningful.
- The test report of the approved inspection body (ZÜS) must confirm that the requested installation can be operated safely if the measures specified in the documents, including the tests, are complied with.

A granted permit expires if:
- you have not started the construction of the installation within two years of the permit being granted,
- you have interrupted the construction of the installation for two years or more, or
- You have not operated the system for a period of three years.
For important reasons, you can apply to the licensing authority for an extension of the deadlines.
Processing Time: 0 - 3 MonthsThe processing time applies from the date of receipt of the complete application documents. An extension of the processing time is possible in justified cases.
Contradiction:
- You may appeal against the decision within one month of notification.
- You must submit the objection to the competent authority in writing or for a record.
- In Rhineland-Palatinate, objections can also be filed in electronic form.
