If a building application has been submitted, the start of construction work for the excavation pit and for individual parts or construction phases of the project can be approved on application before the building permit is issued (partial building permit) in accordance with Section 73 (1) of the Rhineland-Palatinate State Building Regulations (LBauO).

The subject of the partial building permit is on the one hand - as an enacting part - the release of the preparatory construction measures. On the other hand, the partial building permit - as a declaratory part - contains a so-called "provisional positive overall judgment" with regard to the basic approvability of the overall project.

The lower building supervisory authority is responsible for issuing a partial building permit. This is the district administration, in independent and large towns belonging to the district, the municipal administration or the association of municipalities administration if it has been assigned building supervision tasks (Diez and Konz association of municipalities administrations).

A partial building permit can only be granted upon written application; this must be accompanied by all documents required for assessment. As the scope of the required documents depends on the scope of the construction work to be approved, it is not possible to make general statements in this regard. These must be determined in consultation with the locally responsible lower building supervisory authority.
