Prior notification of the construction of an operating area relevant to hazardous incidents
Source: BUS Rheinland-PfalzIf you wish to set up and operate an operating area in accordance with the Major Accidents Ordinance, you must notify the competent authority.
Your notification must contain certain information.
If you have already submitted this information to the competent authority as part of an approval or notification procedure, a separate notification is no longer required.
- You submit the complete notification in writing to the authority responsible for you.
- The authority will check your notification.
- If you have any queries, you may need to provide the authority with further information.
- If an administrative offense has been committed, the competent authority will decide whether to initiate administrative offense proceedings.

You would like to set up and operate an operating area in accordance with the Hazardous Incident Ordinance.
- Complete notification with the required information
- Name or company name of the operator and full address of the relevant operating area
- registered office and full address of the operator
- Name and function of the person responsible for the operating area, if this is not the operator
- sufficient information to identify the hazardous substances and the hazard category of substances
- quantity and physical form of the hazardous substances
- Activity or intended activity in the facilities of the operating area
- circumstances in the immediate vicinity of the operating area that could trigger an incident or exacerbate its consequences. If available, information on
- neighboring operating areas
- other establishments that do not fall within the scope of this Ordinance
- areas and developments:
- from which a major accident could emanate
- where the probability of an incident occurring may increase
- where the effects of an incident and domino effects may be exacerbated
- Complete notification with the required information
- Name or company name of the operator and full address of the business concerned
- registered office and full address of the operator
- Name and function of the person responsible for the operating area, if this is not the operator
- sufficient information to identify the hazardous substances and the hazard category of substances
- quantity and physical form of the hazardous substances
- Activity or intended activity in the facilities of the operating area
- circumstances in the immediate vicinity of the operating area that could trigger an incident or exacerbate its consequences. If available, information on
- neighboring operating areas
- other establishments that do not fall within the scope of this Ordinance
- areas and developments:
- from which a major accident could emanate
- where the probability of an incident occurring may increase
- where the effects of an incident and domino effects may be exacerbated
There are no costs.
You must submit the notification to the competent authority at least one month before the start of construction of the operating area.
There is no statutory processing time.

None. The administrative service is a real act against which no legal remedy is possible.
You are in breach of regulations if you do not report the start of construction of an operating area in accordance with the Hazardous Incident Ordinance, or do not do so correctly, completely, in the prescribed manner or in good time.
