Filing a complaint with the supervisory authority

If possible, submit the supervisory complaint in writing (also by e-mail) with justification. A special form is not necessary.

The authority examines whether it can make a different decision on the merits. If this is the case, you will receive information about the changed decision.

If it does not make a different decision, it usually submits your complaint to the next higher authority. They will then decide on the complaint and inform you of the result.

Note: If you submit the supervisory complaint to an authority that is not competent, it will usually forward your complaint to the competent authority.

Documentation is not required. If you do not file the technical supervisory complaint with the originating authority, but with the next higher authority, it is advisable to attach copies of the documents.

Due to the constitutional principle of judicial independence, decisions of the courts and - in this respect equivalent - decisions of the State Commissioner for Data Protection and Freedom of Information and the members of the Court of Auditors
